Terms of Service — Harbour Bridge Community Care Ltd

1. Introduction and acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the services, activities, sessions, events, workshops, advice sessions, referrals, volunteer placements, and related information provided by Harbour Bridge Community Care Ltd ("we", "us", "our").

By attending, booking, registering for, volunteering with, participating in, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

Where you are using our services on behalf of another person, you confirm that you are authorised to do so and that you will ensure those services are used in accordance with these Terms.

2. Scope of services

Harbour Bridge Community Care Ltd provides community-based support and engagement services, which may include:

• Community support referrals
• Neighbourhood events and activities
• Volunteer coordination and placement
• Family and carers advice sessions
• Digital inclusion workshops
• Wellbeing drop-in sessions

We may also provide related administrative, signposting, communication, or coordination support connected to these services.

Our services are delivered for community support and engagement purposes. Unless expressly stated in writing, our services do not constitute medical treatment, clinical counselling, legal advice, financial advice, social work statutory services, or emergency support.

We may refuse, suspend, or withdraw access to any service where we reasonably consider it necessary for safety, safeguarding, operational, legal, or conduct-related reasons.

3. User obligations and responsibilities

You agree to:

• Provide accurate, current, and complete information when booking, registering, volunteering, or requesting support.
• Behave respectfully and lawfully towards staff, volunteers, service users, visitors, partner organisations, and the public.
• Follow any venue rules, session guidelines, health and safety instructions, and safeguarding procedures communicated by us.
• Not disrupt events, sessions, workshops, or volunteer activities.
• Not use our services for unlawful, abusive, discriminatory, harassing, fraudulent, or harmful purposes.
• Immediately inform us if any information you provided changes and may affect your participation or access to services.
• Take reasonable responsibility for your own belongings, personal safety, and travel arrangements when attending our activities.

If you attend with children, vulnerable adults, or other persons under your care, you remain responsible for their supervision unless we expressly agree otherwise in writing.

You must not record, photograph, or film other participants, staff, or volunteers without appropriate consent and in accordance with any venue or event rules.

4. Payment terms and conditions

Many of our community services are provided free of charge. Where a fee, suggested donation, refundable deposit, or other charge applies, we will make this clear in advance of the relevant service or activity.

If payment is required:

• Payments must be made using the method and by the deadline specified by us.
• Any prices quoted are in pounds sterling unless stated otherwise.
• We may refuse admission or participation where payment has not been received in full by the required time.
• Any third-party charges, bank fees, or transaction fees are your responsibility unless we state otherwise.

We may amend fees for future services at any time. Any change will not affect services already confirmed and paid for, unless required by law or agreed with you.

5. Cancellation and refund policy

Because our services are community-focused and may be delivered on a capacity-limited basis, cancellations can affect other users and our planning. Our cancellation policy is as follows:

• If you need to cancel a booking or place, please notify us as soon as possible using the contact details below.
• For free services, repeated late cancellations or non-attendance may result in restrictions on future bookings.
• For paid services, refunds will only be provided where expressly stated at the time of booking or where required by law.
• If we cancel a paid service that you have booked, we will either offer a refund or, where appropriate, an alternative date or arrangement.
• We are not responsible for any indirect costs you incur in connection with cancellation, including travel, childcare, or lost earnings, unless required by law.

Where a deposit is required to secure attendance or equipment, the deposit may be retained in whole or in part if you cancel late, fail to attend, damage property, or otherwise breach these Terms, subject to applicable law.

6. Liability limitations

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

Subject to the above, Harbour Bridge Community Care Ltd shall not be liable for:

• Any loss arising from your failure to provide accurate information or to follow reasonable instructions.
• Any loss, damage, or injury caused by third parties, including other attendees, volunteers, venue operators, or external providers.
• Any indirect, consequential, incidental, special, or punitive loss or damage.
• Any loss of profits, loss of opportunity, loss of goodwill, or loss of data, to the extent permitted by law.

We provide community support and referral services on an informational and coordination basis. You remain responsible for deciding whether to act on any referral, suggestion, or signposting. We do not guarantee outcomes, availability of third-party services, or the accuracy or completeness of information supplied by external organisations.

Where our liability cannot be excluded, it shall be limited to the amount paid by you for the relevant service, or if no payment was made, to the maximum extent permitted by law.

7. Intellectual property rights

Unless otherwise stated, all content, materials, documents, branding, logos, workshop materials, written guidance, graphics, and website content provided by Harbour Bridge Community Care Ltd are owned by us or licensed to us and are protected by applicable intellectual property laws.

You may use our materials only for your personal, non-commercial use in connection with the relevant service, unless we give you prior written permission otherwise.

You must not copy, reproduce, distribute, modify, publish, sell, sublicense, or exploit our materials without our express written consent.

If you submit feedback, comments, suggestions, or other content to us, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt, and communicate that content for the purposes of improving and delivering our services, unless restricted by law or otherwise agreed in writing.

8. Data protection and privacy

We are committed to handling personal data responsibly and in accordance with applicable data protection laws, including the UK General Data Protection Regulation and the Data Protection Act 2018, where applicable.

• Sharing relevant details with trusted third parties where necessary to deliver a referral or service you have requested, subject to legal basis and appropriate safeguards

We will process personal data in accordance with our privacy practices and any privacy notice we provide. You should ensure that any personal data you provide about another person is shared lawfully and with appropriate authority or consent.

Where we rely on consent for certain processing activities, you may withdraw consent at any time, subject to legal and operational requirements.

9. Force majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events, circumstances, or causes beyond our reasonable control, including but not limited to severe weather, fire, flood, epidemic, pandemic, public health restrictions, utility failure, transport disruption, strikes, industrial disputes, civil unrest, government action, venue unavailability, or supply chain disruption.

Where a force majeure event affects our services, we may cancel, postpone, modify, or suspend services without liability, to the extent permitted by law. We will use reasonable efforts to communicate any changes and offer suitable alternatives where practical.

10. Changes to terms

We may update or amend these Terms from time to time to reflect operational, legal, regulatory, or service-related changes.

Any updated Terms will take effect when published or on the date specified by us. Your continued use of our services after the updated Terms come into effect will constitute acceptance of the revised Terms.

Where a change materially affects a paid booking already confirmed, we will act reasonably and, where required by law, give you notice of the change and any applicable options.

11. Applicable law and jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and interpreted in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction over any dispute, claim, or matter arising from or connected with these Terms, except where mandatory consumer or other applicable law provides otherwise.

13. Severability clause

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful, and enforceable, or if that is not possible, severed from these Terms.

The remaining provisions shall continue in full force and effect.

Harbour Bridge Community Care Ltd reserves all rights not expressly granted in these Terms.
